 Please read this carefully. By submitting an order on this web site you are agreeing to the terms that appear below which will apply to any purchase made through this web site.

By agreeing to these terms and conditions you confirm that you are:

a registered customer of Regency Foods Limited (hereafter referred to as "we", "us" or "our");

that the order is made by a person who is 18 years of age or over;

These Terms and Conditions were last updated on 18th October 2017 and apply to all sales and purchases.

 

1. Purchase Contract

All purchases made on this web site are governed by these Terms and Conditions. The Terms and Conditions governing any purchase will be those in effect at the date of your order. We reserve the right at our sole discretion to amend these Terms and Conditions at any time. If you order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.
We will confirm receipt of your order as soon as possible by e-mail, to the e-mail address you provided to us. Our acceptance of your order will take place upon despatch of the product(s) ordered and at this point the purchase contract will be made. We will supply the goods to you in accordance with these Terms and Conditions.

 

2. Pricing and Availability

All prices are quoted excluding VAT. Where applicable, VAT will be added to invoices.
Prices are liable to change without prior notice.
Please check the dates of availability of any offers before purchasing.
Products are subject to availability and prevailing market conditions. We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer.
If you would like us not to deliver a substitute line should selected lines be unavailable, you can request this when placing your order.
Product descriptions and prices should only be used as a guide and Regency Foods reserves the right to vary them without notice.

 

3. Delivery

Delivery will be made to the address specified by you when you register on the website.
We Currently Only deliver to London Post Codes within the M25.
Delivery will be made only to London Post Codes and adults aged 18 years or over.
Delivery times, where agreed, are approximate only and subject to clause 9 below there shall be no liability on Regency Foods for late or cancelled delivery.
It is your responsibility to ensure that an appropriate person is available at the delivery address at all times during the agreed date and time. All goods must be signed for on delivery by an adult aged 18 years or over. Shortages and Damaged Goods must be noted on Delivery and reported to our office within 3 days from delivery date.
If no one is at the address when delivery is attempted the goods will be retained by us.
Should you fail to be present for your delivery we are entitled to charge you in full price of the items contained in your order and the cost of delivery.
All alcohol must be checked off at time of delivery and queries reported to the delivery driver immediately. No discrepancies will be entertained if such goods are not checked off at time of delivery.
All goods remain the property of Regency Foods Limited until payment has been made in full and received in full by Regency Foods.

 

4. Claims For Damage In Transit/Defects

No claims for non-delivery or shortages in quantity of units delivered, defective Goods, partial loss or damage to Goods will be accepted by the Seller unless: (a) they are notified in writing by the Buyer to the Seller on delivery (in the case of shortage in quantity of units delivered, by the Buyer indicating the shortage on the delivery documents) or within 2 days after the Date of Delivery (in the case of partial loss or damaged Goods) or 14 days after the Date of Delivery (in the case of defective Goods) or 3 days after the date of the invoice (in the case of non-delivery) and (b) the Goods in respect of which a claim is made together with the packaging are preserved intact as received for a period of 21 days from notification of any such claim and the Buyer permits the Seller or its servants or agents full and free right of access to inspect the Goods and investigate the claim. Section 3 Sale and Supply of Goods Act 1994 shall not apply.

 

5. Returns

You may return most dry store items (ambient products) within 72 Hours of delivery for a full refund. We'll also pay the return shipping costs if the return is a result of our error (you received an incorrect or defective item, etc.).

Fresh and Frozen products have to examined at the point of delivery as no return will be accepted after.  


You should expect to receive your refund within four weeks of giving your package to the return shipper, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days).

 

6. Payment

Payment may be made by debit or credit card. Regency Foods Limited reserves the right to refuse delivery if these terms are not adhered to.
Payment Method accepted by us are those listed on the web site on the date on which your order is placed.

 

7. Availability of service

The service may be unavailable at certain times to allow Regency Foods Limited to maintain and upgrade the website. Although Regency Foods Limited will always endeavour to inform customers in advance of any service unavailability, this cannot be guaranteed. Regency Foods Limited reserves the right to alter or withdraw the service at any time and also reserve the right to refuse the service to any customer without giving a reason.

9. Warranty and Liability

Nothing in these Terms and Conditions will restrict our liability for death or personal injury resulting from our negligence, breach of contract or breach of statutory duty.
In addition to clause 4, we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war, breakdown of equipment, road traffic problems.
Regency Foods Limited is constantly monitoring and checking the information on this website while we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. We would advise you to check the label or product packaging, prior to use.
Where precise information is important to you on a branded line, please contact the manufacturer whose contact details appear on the packaging or label. For any Regency Foods Limited own label product, please contact our Customer Relations team on 0208 2081200.
Where a product description contains a link to another party’s website, please note that Regency Foods Limited does not vet these websites and has no control over their contents. Regency Foods Limited cannot accept any liability in respect of the use of those 3rd Party websites.
This information is supplied for your personal use only in placing orders through this web site, and you may not copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
Regency Foods Limited makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it won't cause damage to your computer. If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
The content of this website is owned or licensed by Regency Foods Limited. This material includes, but is not limited to, photos, images, layout, graphics, look and appearance. The content of the site is protected by copyright, trademarks, database and other intellectual property rights and any such rights will remain vested in Regency Foods Limited or our licensors.
You can use this site only for your own personal, non-commercial use, in order to place orders through the website.
You may not reproduce, copy, duplicate, transmit, publish, display, distribute or sell any material from the Regency Foods Limited website.
